The terms on which BHARCS provides its courses and workshops, and on which the BHARCS Website and Portals may be used. This revision merges the separate Website Terms of Service, adds terms for subscription billing, and confirms that the published policies form part of the agreement.
BHARCS is owned and operated by Sindhoor Pangal, and references to “BHARCS,” “we,” “us” and “our” mean BHARCS and its proprietor. BHARCS offers to provide Canine Behaviour Education, more fully described in www.BHARCS.com, (the “BHARCS Website”) and delivered through courses.bharcs.com & learn.bharcs.com (the “BHARCS Portals”), is broken up into several courses, hereinafter referred to as “Courses” to the student, which includes online self learning units, (“Online Units”) as well as in-person intensives, (“Workshops”), subject to the terms and upon the conditions set out hereinafter (and as may be amended by US from time to time). By using the BHARCS Website or the BHARCS Portals you accept these terms, whether or not you enrol in a Course.
- COURSES, ONLINE UNITS & WORKSHOPS
- The student may be allowed to attend workshops with their dog at their own risk and with the prior consent of BHARCS. We may, at any time and without assigning any reason, request that the dog be removed from the venue of the workshop. The terms and conditions pertaining to accompanying dogs, if any, shall be intimated prior to commencement of the workshop and may be amended from time to time.
- BHARCS reserves the right to refuse registration or the right to continue to attend any workshops / courses.
- The dates and the venue for the workshops / courses are set out in the BHARCS Website.
- Pursuant to successful completion of a workshop / course by the student, BHARCS may issue a participation certificate to the student. Use of the certificate will be governed by the policy specific to the issued certificate.
- PAYMENT
- The student shall pay the fees as published in the Enrollment policy of each workshop / course more fully set out in the policies section of the BHARCS Website (the “Tuition Fee”) to BHARCS, along with a completed and electronically submitted application for enrolment, where applicable. The Tuition Fee is non-refundable except in accordance with paragraph 3.
- Payments are collected through third-party payment processors. The student's payment instrument details are provided directly to and handled by the processor; BHARCS does not store the student's card, bank or UPI credentials.
- CANCELLATION AND RESCHEDULING OF IN-PERSON WORKSHOPS
- BHARCS may cancel a workshop at any time prior to the commencement of the workshop (the “Workshop Date”). If BHARCS cancels the workshop, then the Tuition Fee paid shall be refunded to the student.
- If the student cancels the registration for workshop 15 (fifteen) days prior to the workshop date 50% (fifty percent) of the Tuition Fee shall be refunded. There shall be no refund of the workshop fee for any cancellation later than 15 (fifteen) days prior to the Workshop Date.
- If BHARCS reschedules the workshop, the student may choose to attend the workshop on the rescheduled date, or find a slot on a future Workshop Date or claim a refund of 50% (fifty percent) of the Tuition Fee, if paid.
- If the student has been unable to attend the Workshop, the student may check with BHARCS for available seats in future Workshop Dates that might open up due to cancellations. A seat cannot be guaranteed. In case a seat is not available, the Tuition fee, if paid by the student, shall be forfeited by the student
- If the student registers for the Workshop and does not cancel the Workshop, but in any event does not attend the Workshop, then BHARCS shall retain the full Tuition Fee.
- ONLINE COURSES
- Access to a Course delivered through the BHARCS Portals is contingent on payment of the applicable fees. Fees for Courses (the "Course Fees") are as published on the BHARCS Website and, unless stated otherwise for a specific Course, are payable in accordance with the Enrollment, Fees and Extensions Policy. The student retains access to Course until the end of the applicable billing period.
- Where a Course is offered on a subscription basis (as stated in the Enrollment, Fees and Extensions Policy), the student, by subscribing, authorises BHARCS and its payment processor to charge the applicable fee to the student's chosen payment method automatically on a recurring basis until the subscription is cancelled. Billing cycles, cancellation, lapse, reinstatement and any catch-up fees are as set out in the Enrollment, Fees and Extensions Policy applicable to that Course.
- If Course Fees remain unpaid beyond their due date, the student's access to the Course may be restricted or the student's enrolment suspended, in accordance with the Enrollment, Fees and Extensions Policy. Reinstatement following suspension is subject to clearance of all dues as set out in that policy.
- BHARCS may suspend or terminate a student's enrolment in a Course in accordance with its published policies, including without limitation for non-payment of Course Fees, academic malpractice, or violation of the BHARCS Code. The final decision on termination of enrolment rests with the Director of the Academy.
- Course Fees are not refundable.
- LIABILITY
- BHARCS shall have no liability to the student for any claim in respect of the dog accompanying the student.
- BHARCS shall not be responsible to the student in the event that the Workshop cannot be conducted due to a Force Majeure Event. For purposes of this paragraph, a ‘Force Majeure Event’ shall mean an act beyond the reasonable control of BHARCS, which shall include but not be limited to acts of God, riots, acts of war, epidemics, earthquakes, or other natural or man made disasters, strikes or other industrial action, failure of telecommunication services, governmental regulations, actions of any government or public body or power failure(s). In the event that we are prevented from running a Workshop due to a Force Majeure Event, BHARCS shall take reasonable steps to try and provide the Workshop to the student as soon as is reasonably practicable.
- BHARCS makes no representations or warranties, express or implied, as to the accuracy or effectiveness of the Workshops and Courses. EXCEPT AS SPECIFICALLY PROVIDED IN THIS TERMS OF SERVICE, THE BHARCS WEBSITE, THE COURSE CONTENT AND MATERIALS AND METHODS OF CONDUCTING THE COURSE (THE “BHARCS CONTENT”), THE BHARCS CONTENT IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF PERFORMANCE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OMISSIONS, COMPLETENESS, CURRENTNESS AND DELAYS. IN NO EVENT SHALL BHARCS BE LIABLE TO THE STUDENT FOR ANY CLAIM(S) RELATING IN ANY WAY TO (i) THE STUDENT’S INABILITY OR FAILURE TO PERFORM THE ACTIVITIES PRESENTED IN THE BHARCS CONTENT PROPERLY OR COMPLETELY, EVEN IF ASSISTED BY BHARCS, OR ANY DECISION MADE OR ACTION TAKEN BY THE STUDENT IN RELIANCE UPON THE BHARCS CONTENT; OR (ii) THE STUDENT’S MISUSE OR WRONGFUL USE OF THE BHARCS CONTENT AND/OR WRONGFUL PRACTICE OF THE PROFESSION OF CANINE BEHAVIOUR COUNSELLING DURING ALL OF BHARCS COURSES AND PURSUANT TO RECEIPT OF THE CERTIFICATE (ii) ANY LOST PROFITS OR OTHER CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, INDIRECT OR SPECIAL DAMAGES RELATING IN WHOLE OR IN PART TO THE STUDENT’S USE OF, OR INABILITY TO USE, THE BHARCS CONTENT EVEN IF BHARCS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BHARCS MAKES NO WARRANTY THAT ACCESS TO THE BHARCS CONTENT WILL BE UNINTERRUPTED, SECURE, COMPLETE OR ERROR FREE. NOR DOES BHARCS MAKE ANY WARRANTY AS TO THE LIFE OF THE BHARCS CONTENT. THE STUDENT ACKNOWLEDGES THAT PROVIDING THE BHARCS CONTENT ENTAILS THE LIKELIHOOD OF SOME HUMAN AND MACHINE ERRORS, DELAYS, INTERRUPTIONS AND LOSSES, INCLUDING THE INADVERTENT LOSS OF CONTENT OR DAMAGE TO MEDIA. To the extent permitted by applicable law for the time being in force, BHARCS expressly excludes all conditions, warranties and other terms, which might otherwise be implied by statute, common law or the law of equity.
- BHARCS shall have no liability whatsoever with respect to the appropriateness of the Workshop/Course to the student in respect of their physical capability.
- Whilst every effort shall be made to help and improve the well being of the student, BHARCS shall have no liability for any accident, injury or illness arising from the Course / Workshops.
- The student forever releases BHARCS, its employees, agents and any other person claiming through or under BHARCS from any and all liability, claims and demands which the student, their legal heirs, assignees, representatives or any person claiming through or under them may have or may hereafter have in relation to the BHARCS Courses & workshops, and assume all risks thereof.
- INTELLECTUAL PROPERTY
- The student acknowledges that, as between the student and BHARCS, BHARCS is the sole, exclusive and perpetual owner of all of the Intellectual Property. For purposes of this paragraph, ‘Intellectual Property’ shall mean the Educational content, Confidential Information, all trade names, service marks, motifs, logos, texts, graphics, registered designs, domain names and utility models, content of the BHARCS Website organisation, BHARCS Portals and layout of the BHARCS owned Websites, BHARCS Portals and other the software used in relation to the BHARCS Website and BHARCS Portals, copyrights, inventions, brand names, database rights, know-how, information and any similar rights situate in any country and the benefit (subject to the burden) of any of the foregoing (in each case whether registered or unregistered and including applications for the grant of any of the foregoing and the right to apply for any of the foregoing in any part of the world). ‘Confidential Information’ shall include but is not limited to the BHARCS Content, technical and commercial information, BHARCS’s methodology for promoting its services, financial arrangements, competitive status, pricing policies, knowledge of suppliers, technical capabilities, discoveries, algorithms, concepts, designs, drawings, specifications, techniques, models, data, technical manuals, training guides and manuals, research and development materials, processes, procedures, know-how and other business affairs relating to BHARCS. Except to the extent set out in paragraph 6.b and subject to the terms and upon the conditions set out in paragraph 6.b, the student shall have no right and/or claim whatsoever on the Intellectual Property.
- The student shall be aware that when the student is accessing the BHARCS Website or BHARCS Portals, the student may be directed, by selecting links, to other websites that are beyond the control of BHARCS. There may be links to other websites from BHARCS that take you outside of the BHARCS Website or BHARCS Portal. BHARCS does not endorse the content found on such third-party websites. The student shall assume sole responsibility for the student’s use of third-party links and pointers. All other intellectual property designated as such on the BHARCS Website or BHARCS Portals are the intellectual property of their respective owners and the student shall require their specific authorization should the student wish to use any of the intellectual property. Upon receipt of Professional Certificates from BHARCS (Canine Essential 101 is not a professional course and participants will not be issued any professional certificates after this particular course), the student may be granted a non-exclusive, non-transferable, limited license to access the Intellectual Property for the limited purpose of applying the BHARCS Content in the participant's own practice of canine behaviour consultancy (the “Licensed Content”) at the discretion of and with the prior written consent of BHARCS and which license may be revoked at any time by BHARCS. The student shall not sublicense, transfer or otherwise make available any Licensed Content to any third party for purposes not authorized by BHARCS including but not limited to commercial purposes or financial gain or use the Licensed Content in any other media or in any other location. The student shall not alter or modify the Licensed Content in any way. The student shall not copy, download, store, publish, transmit, transfer, sell, republish, upload, distribute, or otherwise use the Licensed Content, or any portion of the Licensed Content, in any form or by any means, except as expressly permitted by BHARCS in writing. The student shall not sell, license or distribute the Licensed Content to third parties or use Licensed Content as a component of or as a basis for any material offered for sale, license or distribution. The Licensed Content shall not be stored or used in an archival database or other searchable database except as expressly permitted by BHARCS. For the avoidance of doubt, this licence relates solely to the use of BHARCS Intellectual Property and does not constitute a professional, statutory or governmental licence to practise canine behaviour consultancy.
- MISCELLANEOUS
- The contents of this Terms of Service contains the entire agreement of BHARCS and the student with respect to the subject matter hereof, and supersedes and all prior agreements relating to the subject matter hereof. BHARCS may update the terms and continued enrollment constitutes acceptance. These terms are to be read together with the policies published in the policies section of the BHARCS Website, including the IP Protection Policy and the Enrollment, Fees and Extensions Policy, which form part of this agreement.
- Any notice required or permitted to be given in relation to the Course in particular and an application for enrolment in general shall be sufficient if the same is in writing and sent by electronic mail to the student addressed to the electronic mail account denoted below and to BHARCS at learn@bharcs.com.
- All claims, controversies, disputes or differences between BHARCS and the student, arising out of or in connection with or in relation to the Course in particular and this Terms of Service in general shall be subject to the jurisdiction of the Courts at Bangalore, Karnataka, India.
- When using the BHARCS Website or the BHARCS Portals, the student shall not: republish, sell, sublicense or otherwise commercialise material obtained from them; use them in any way that damages them or impairs their availability to others; use automated means to extract data from them; or use them contrary to applicable law.
- If any provision of these terms is found to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force.
Declaration
I hereby declare that I am above 18 (eighteen) years of age at the time of registration for the Course. I hereby declare and confirm that I have read the contents of this Terms of Service and the additional relevant contents set out in the BHARCS Website carefully and understand, agree to and accept the contents hereof and thereof. I further hereby declare that the information I have provided in the application for enrolment is correct at the time of registration and I acknowledge that it is my responsibility to inform BHARCS of any changes to the details provided by me. I affirm that I have read the BHARCS Code (more fully set out in the BHARCS Website) (the “Code”) and that in registering for the Course, I agree to abide by the principles of the Code during any practice of Canine Behaviour Counseling. I also agree to be bound by and submit to all BHARCS rules and regulations in their current form and as they may be amended from time to time
